Obtaining a Certificate of Eligibility is essential for foreigners who wish to stay in Japan. However, if you no longer plan to come to Japan after applying for this certificate, can you cancel the application? Let us explain in detail.

What is an application for Certificate of Eligibility?

An application for Certificate of Eligibility is an application to request a Certificate of Eligibility. The Certificate of Eligibility certifies that your activities in Japan and your status as a spouse of a Japanese national are not deceptive and that you meet the requirements of your status of residence.

Without this certificate, the alien cannot engage in the activities planned in Japan. Therefore, before a foreigner enters Japan, he/she must obtain a certificate in advance in his/her home country.

The Certificate of Eligibility is required when a foreigner lands in Japan. In addition to the Certificate of Eligibility, a passport and visa must also be presented at the time of landing.

How to Obtain

There are two ways to obtain a Certificate of Eligibility: the foreign national can come to Japan and apply for it in person, or a company that employs the foreign national can apply for it on behalf of the foreign national in Japan.

However, the first method requires the foreigner to come to Japan and places a heavy burden on the foreigner, so in most cases, the company that employs the foreigner will file the application in Japan on behalf of the foreigner. In most cases, the company hiring the foreign national will apply for the visa in Japan on behalf of the foreign national. Employees working for a registered support organization can also apply for a Specified Technical Visa on behalf of a foreign national. For status of residence visas, if you have a foreign relative in Japan, he or she can apply on your behalf.

The Certificate of Eligibility will be mailed to the applicant approximately one to three months after the application for the Certificate of Eligibility is filed. In the proxy application, the certificate will be sent to the foreigner himself/herself in his/her home country. The foreigner presents the certificate at the Japanese embassy or consulate in his/her home country and applies for a visa.

However, please note that the Certificate of Eligibility is valid for three months. If it expires after three months from the date of issue, it will become invalid.

What is the procedure for cancellation?

If your plans change after applying for a Certificate of Eligibility and you are unable to go to Japan, you may withdraw your application. Even if your application has been approved, you may withdraw it within a certain period of time.

In order to avoid any trouble, the withdrawal must be made in writing, not by phone or e-mail, but by presenting or sending a document. There is no specific format, but the document should be titled “Application for Withdrawal of Application,” and should include the date of application, applicant, address, contact information, and a statement that the application is being withdrawn.

Once the “Application for Withdrawal of Application” is prepared, it should be brought in person to the Immigration Office where the application was submitted, or mailed to the Immigration Office where the application was submitted.
